PHOTOGRAPHY BY MAYA

 

Note – Photography by Maya shall be referred to as PBM. 

All images are chosen by a photographer unless agreed otherwise with a client.

Due to the artistic nature of the photography business, PBM retains the right to use the images for the purposes of advertising, marketing or promotion of its work unless otherwise agreed with the Client prior the session in writing. PBM must receive a written notification (e.g., via a message or email), that the Client do not wish to share their images publicly prior coming for a session.

APPLICABLE LAW

1. The laws of England and Wales shall govern this agreement.

2. These Terms and Conditions shall not be varied except by agreement in writing.

3. In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the Client and in the absence of any contrary agreement in writing, these Terms and Conditions shall prevail.

PROCESSING TIME & RRINTS

1. Processing time is 2-5 weeks and digital images will be shared as soon as they are completed. 

2. Images can be printed on the client request, depend on the type of session (additional cost apply, where applicable).

3. All images will be shared digitally via online gallery, email or USB stick.

4. Prints will be discarded after 6 months if not collected by Client.

COPYRIGHT & REPRODUCTION

1. Copyright is always retained by PBM.

2. No image can be copied, scanned or reproduced in any form without the prior consent of PBM. This includes saving, screen grabbing and downloading from Facebook or other social media.

3. Images can not be altered or added to or manipulated by means of computer or any other technique without prior written consent.

4. No image, either processed or unprocessed (given as a gift), can be edited by other photographers, family members or any other person.

5. It is illegal to attempt to download, or to attempt to remove a watermark from, any image taken and posted online by PBM for any reason.

BOOKING FEE & REFUND POLICY

1. By booking a session with PBM you enter into a contract and have therefore agree to abide by the terms and conditions.

2. Booking fees taken for newborn, maternity & portrait sessions are non-refundable except in the event PBM cancels the booking.

3. Bookings can be for a different session of the same value.

4. All prices are subject to change without notice by PBM. Prices agreed with Clients at the time of booking remain the same.

5. In order to secure the appointment, the booking fee of non-refundable £30 is due in full by the client at the time of booking. PBM will not hold any dates open without booking fee payment. The deposit will be taken off the final fee on the day of the session.

6. In the event of an illness or misadventure, please call as soon as possible to reschedule. PBM maintains the right to reschedule at any time should it become necessary but will do her upmost to negotiate a mutual acceptable rebooking. The request must be made no later than 24 hours prior to the start of the photography session.

GIFT VOUCHERS & MODEL CALL SESSIONS

1. Gift vouchers purchased from PBM are only valid for 6 or 12 months from date of purchase, depending on the type of session.

2. Gift vouchers cannot be exchanged for cash and are non-transferable. No refunds will be given.

3. Model call: PBM reserves the right to use all images for the purposes of advertising or promotion of its work. Maximum of 3 images are given to a client free of charge. The consent must be agreed prior commencing session.

CAMERA POLICY

1. Cameras, camera phones, camcorders or any other recording equipment is NOT permitted during any session, either in the studio or on location, without the express permission of PBM.

CAKE SMASH / NEWBORN & CHILDREN SESSION

1. It is the client’s responsibility to inform PBM of any food allergy or intolerances the client’s baby has prior to ordering/bringing the cake. PBM will not be held liable for any adverse reactions or illness the baby may suffer because of an allergy if the Client did not inform PBM. By signing the contract, you waive all rights to sue PBM if any illness results due to lack of information given to PBM by the client.

2. The Client is responsible for the newborn/children's safety during the photography session. The Client must therefore ensure that a responsible adult, other than the Photographer, is always present to supervise the children. If for any reasons the Client is concerned of the baby/child safety, the Client must inform the PBM immediately and the session will be discontinued.

3. All reasonable precautions will be taken by PBM to maintain a safe working environment and use of safe props.

4. The client must confirm that the newborn baby is free from any obstruction after the session/upon leaving the studio and that all props/ positions have been used in a safely manner. 

COVID-19

1. All bookings are subject to government guidelines regarding Covid 19. Should your session be unable to go ahead, it will be swapped for an age-appropriate session of equal value as soon as it is safe to do so.

2. While every safety precaution is taken to minimise risk, by placing a booking Client accepts that PBM will not be held responsible for any infection of COVID-19 after the Client’s session.
